Terms and conditions.

Effective Date: January 1st, 2025

Introduction

Welcome to our platform. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the "Service") provided by American Eservices LLC (AES) 8950 SW 74th Court #2201-F9 Miami, Florida, USA ("American Eservices", "AES", "we", "our" or "us"), including any content, tools, or products made available through them.

By accessing or using our Service, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy and any additional terms that may apply.

Acceptance of Terms

When you use our Service, create an account, or confirm your acceptance (for example, by clicking "Accept"), you enter into a legally binding agreement with us.

If you do not agree with these Terms, you must not use the Service.

These Terms apply to all users, whether you are simply browsing or actively using our services.

If the Service is used on behalf of a minor, the parent or legal guardian is responsible for supervising usage and accepting these Terms on the minor's behalf. Individuals under 18 may only use the Service with parental or guardian approval.

Important Notice on Dispute Resolution

By agreeing to these Terms, you acknowledge that most disputes will be resolved through binding arbitration, rather than through court proceedings. This means you waive the right to a jury trial and participation in class actions, as detailed later in this document.

User Accounts and Responsibilities

You may browse certain parts of our website without registering. However, to access key features—such as submitting applications or making purchases—you must create an account and provide accurate information.

You are responsible for:

• Keeping your account information accurate and up to date
• Protecting your login credentials
• All activity that occurs under your account

If you suspect unauthorized access, you must notify us immediately.

We are not responsible for any loss resulting from failure to protect your account information.

Our Role and Relationship with You

We operate as a private service provider and are not affiliated with any government authority.

Our Service is designed to assist users by simplifying application processes, providing guidance, and preparing documentation. However:

• We do not provide legal advice
• We do not guarantee approval of any visa or travel document
• Any information we provide is for general guidance only.

Privacy and Data Use

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

While we implement security measures to protect your data, no system is completely secure. You acknowledge that submitting information online carries inherent risks.

You are responsible for securing your own devices and logging out after use.

User Accounts and Security

To access certain features of our Service, you may be required to create an account and provide personal details ("Account Information").

You agree to:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your login credentials
• Be fully responsible for all activities conducted through your account

We recommend using a strong, unique password and logging out after each session.

If you suspect unauthorized use of your account, you must notify us immediately. We are not responsible for any loss or damage resulting from your failure to secure your account.

You may not:

• Copy, modify, or distribute any part of the Service
• Reverse engineer or attempt to extract source code
• Use the Service for unlawful or unauthorized purposes

Your Data and Content

You retain ownership of the information and data you submit through the Service.

However, by using the Service, you grant us a worldwide, royalty-free license to:

• Process and store your data
• Use it to deliver the Service
• Adapt it for technical purposes (e.g., formatting for devices)

This is necessary for us to operate and provide the Service effectively.

We may also share your data with trusted third parties strictly for service delivery or legal compliance purposes.

Our Intellectual Property

All elements of the Service—including software, design, text, graphics, logos, and content—are owned by us or our licensors and are protected by intellectual property laws.

You agree not to:

This may include:

By using the Service, you agree that these third parties may be involved.

We are not responsible for the actions or performance of third-party providers.

Third-Party Software

Some parts of the Service may include software provided by third parties.

Your use of such software is subject to the terms of those third parties, and we disclaim any responsibility related to them.

We may provide updates to improve the Service, including security or functionality enhancements.

In some cases, updates may be required for continued use of the Service.

You agree to accept these updates as part of your use of the Service.

We reserve the right to take appropriate action, including suspension or termination of access, if these rules are violated.

User Responsibilities for Travel Documents

If you receive any document through our Service (such as a visa-related document or application output), you are responsible for:

• Carefully reviewing all information for accuracy
• Notifying us promptly of any errors
• Ensuring your passport and personal details meet applicable requirements

Failure to verify your documents may result in issues with your travel, for which you are solely responsible.

You are also responsible for ensuring that communications from us (including emails) are not blocked by spam filters.

No Guarantee of Outcome

Use of our Service does not guarantee any specific result.

In particular:

• We do not guarantee approval of any visa or travel document

While we aim to keep information accurate and up to date:

• We do not guarantee its completeness or reliability
• Government policies and requirements may change at any time

Any reliance on information provided through the Service is at your own risk.

Third-Party Links and Services

The Service may include links or references to third-party websites, products, or services.

We may also work with third-party providers for certain services.

You acknowledge that:

• We do not control third-party content or services
• We are not responsible for their performance or accuracy
• Any interactions with third parties are solely between you and them

We recommend reviewing their terms and policies before engaging with them.

Use of Artificial Intelligence Tools

We may use artificial intelligence (AI) technologies to enhance the Service.

You acknowledge that:

• AI-generated responses may not always be accurate or complete

• AI-generated content does not necessarily reflect our official views.

Service Availability and Modifications

We strive to keep the Service available and functional at all times, but we do not guarantee uninterrupted access.

The Service may be affected by:

• Maintenance
• Technical issues
• External factors beyond our control

We may suspend, modify, or discontinue the Service (or parts of it) at any time without liability.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, including:

• Implied warranties of merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability of the Service

We do not guarantee that the Service will be error-free, secure, or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• This includes loss of data, profits, or opportunities
• Our total liability for any claim related to the Service will not exceed USD $100.

Any claim must be brought within one (1) year from the date the issue arose.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights

This includes legal fees and related costs.

Account Suspension and Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• You violate these Terms
• We discontinue the Service
• We determine it is necessary for legal or security reasons

Upon termination:

• Your access to the Service may be removed
• We are not obligated to retain or return your data
• Certain provisions (such as liability limitations and dispute resolution) will continue to apply.

Dispute Resolution (Arbitration Agreement)

By using our Service, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court.

This means:

• You waive your right to a jury trial
• You waive participation in class actions or collective proceedings

Arbitration will be conducted by a recognized arbitration body under its applicable rules. The arbitrator may award the same remedies as a court but only on an individual basis.

Each party will bear its own legal costs unless otherwise required by law.

Exceptions to Arbitration

Notwithstanding the above, either party may:

• Bring claims in small claims court (where applicable)
• Seek injunctive or urgent relief in a competent court for intellectual property or unauthorized use issues

Time Limit for Claims

Any claim related to the Service must be initiated within 3 months from the date the issue arose.

Failure to do so will permanently waive your right to bring such a claim.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Agency Relationship

Nothing in these Terms creates any partnership, employment, or agency relationship between you and us.

Assignment

You may not transfer your rights under these Terms.

We may assign or transfer our rights and obligations at our discretion, including in the event of a merger, sale, or business transfer.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms, constitute the full agreement between you and us regarding the Service.

Pricing and Payments

All prices displayed include our service fees and may also include applicable government fees where specified.

You agree to:

• Pay all charges associated with your order
• Use a valid and authorized payment method

We reserve the right to:

• Modify pricing at any time (without affecting completed orders)
• Refuse or cancel orders if necessary

Payment Processing

Payments may be processed through third-party providers.

By completing a transaction, you acknowledge that:

• Your payment is subject to the terms of the payment provider
• We are not responsible for payment processor issues

Order Processing

Once an order is submitted:

• Processing begins immediately
• Orders cannot be modified or canceled once processing has started

This is essential due to the rapid nature of digital application handling.

Refund Policy — General Principle

By purchasing our Service, you acknowledge that you are paying for a digital assistance service, not for a government-issued visa or guarantee of approval.

Our service is considered rendered as soon as processing begins, which includes but is not limited to:

• Data review
• Application preparation
• Translation
• Submission or transmission of information

Non-Refundable Services

No refund will be issued in the following cases:

• The application has been processed, reviewed, or submitted
• The customer changes their mind after submission
• A visa or travel authorization is denied by a government authority
• Incorrect or incomplete information was provided by the customer
• The customer failed to attend an appointment or provide required documents
• Processing has already started, even if not completed

Cancellation After Processing Has Begun but Before Submission

If the customer requests cancellation after we have begun processing or reviewing the application or before the application has been submitted to the relevant government authority, we may accept the cancellation request and issue a partial refund.

In such cases, a USD $35 processing fee will be deducted from the amount refunded to cover work already performed in connection with the application, including administrative processing, application review, preparation, customer support, and other services already provided.

Once the application has been submitted to the relevant government authority, the service becomes non-refundable.

Government Fees

Government fees (if applicable):

• Are separate from our service fees
• Are non-refundable under all circumstances

Limited Refund Eligibility

A refund may only be considered if:

• The request is made before any processing has started, AND
• No work has been performed on the application

In such cases, an administrative fee may apply.

Duplicate or Unauthorized Transactions

If you believe a transaction was made in error or without authorization, you must contact us immediately.

We will investigate and, where appropriate, issue a resolution.

Chargebacks and Disputes

Before initiating a chargeback, you agree to contact our support team to resolve the issue.

You acknowledge that:

• Filing a chargeback for a service that has already been delivered constitutes a violation of these Terms
• We reserve the right to submit evidence of service fulfillment, including: application records, IP address logs, signed acknowledgments, and delivered documents

We also reserve the right to:

• Contest all unjustified chargebacks
• Restrict future access to our Service

Customer Responsibility Acknowledgment

By completing a purchase, you confirm that:

• You understand we are a private third-party service provider
• You understand that approval is not guaranteed
• You accept that service fees are earned upon initiation of processing

Refund Discretion

In rare cases, we may choose to issue a refund as a gesture of goodwill.

Such refunds:

• Are made at our sole discretion
• Do not constitute an obligation or precedent

Contact for Refund Requests

All refund requests must be submitted through our official support channels.
